Legislative Inquiry into Land Rights of Farmers in Fquih Ben Salah

A parliamentary representative from the National Rally of Independents, Saleh Hani, has formally questioned the Minister of Agriculture, Fisheries, Rural Development, and Water and Forests, Ahmed Bouari, regarding the complex legal status of irrigated lands in sectors 504, 505, and 508 of Fquih Ben Salah. This inquiry sheds light on a pressing issue that impacts the livelihoods of local farmers and the agricultural sector’s viability.

Complicated Land Ownership Issues

Hani’s query points to a historical backdrop, where a number of local farmers are struggling with convoluted property rights linked to land amalgamation efforts initiated as far back as 1951, with further actions taken in 1978 and a resumption of mergers sanctioned by a decree in 1991. In an effort to clarify ownership, recent legal searches have led to the submission of new land registration applications. However, complications arose when a ministerial order in 2001 invalidated earlier judgments related to land regularization, which only deepened the existing legal quagmire.

Impact on Farmers’ Rights and Livelihoods

The ramifications of this legal ambiguity are significant. Over 1,500 farmers have been actively cultivating nearly 3,000 hectares of these crucial irrigated lands for years, yet they lack the necessary legal documentation to secure their property rights and utilize the land effectively. This precarious situation exacerbates economic and social struggles among these farmers, stripping them of full access to vital government programs aimed at supporting and modernizing Morocco’s agricultural landscape.

Call for Action from the Ministry

In his inquiry, Hani urged the Ministry of Agriculture to outline the steps it plans to take to resolve the legal status of these irrigated lands in the affected sectors. He emphasized the necessity for a definitive solution that safeguards the rights of the farmers and enables them to benefit from development and support initiatives designed to uplift the agricultural sector and rural communities.
