Government Approves Controversial Reforms to Legal Profession Law

In a significant move, Morocco’s government, led by Justice Minister Abdellatif Ouahbi, has endorsed a series of amendments to Law No. 66.23, which governs the legal profession. Key changes include raising the age limit for legal practice entry from 40 to 45 years and exempting certain law professors from proficiency certificates and training periods, while expanding the role of lawyers to encompass responsibilities for sports and artistic representation.

The recent approval by the Justice and Human Rights Committee of the House of Representatives follows lengthy discussions that saw the introduction of over 500 amendments from both majority and opposition parties. The project passed with 16 votes in favor and 6 against, with no abstentions recorded. This legislative advancement indicates a shift in the regulatory landscape of the legal profession, reflecting evolving needs and societal demands.

A major reform is the elevation of the age threshold for entering the profession. Furthermore, the government has stipulated that prospective lawyers must possess a master’s degree, a condition that remains a point of contention.

The committee also agreed to exempt senior law professors from the usual proficiency certificate and training requirements, provided they have a minimum of eight years of teaching experience and completed their previous duties without disciplinary issues. This decision has sparked debate, particularly regarding the inclusion of Sharia college professors who teach legal subjects, but ultimately, these professors were not granted the same exemptions.

The Role of Lawyers Expands Amid Legal Market Shifts

Another significant amendment allows lawyers to represent clients in sports and artistic matters, reflecting changes in the legal services market and the need for legal practitioners to adapt to new sectors. This expansion of roles positions lawyers to play a crucial part in contract negotiations and legal representation in these dynamic fields.

While the Justice Minister championed the introduction of a final exam at the bar institute as a quality assurance measure, this proposal faced criticism from several deputies. They argued that it could further complicate access to the profession, introducing what they described as a bureaucratic barrier.

Future Prospects and Ongoing Debates

Other notable adjustments include altering the composition of regulatory body councils by reducing the influence of former bar presidents and recalibrating representation based on seniority. Additionally, processes for disciplinary matters will now have shortened timelines, a concession aimed at improving efficiency in legal proceedings.

As the law progresses through parliament, it continues to generate contentious discussions among legal practitioners and political actors. The debate centers on access conditions and the broader implications of these reforms for the legal profession in Morocco.
