The national debate on “Managing State Disputes and Preventing Them: A Gateway to Preserving Legitimacy, Ensuring Investment Stability, and Rationalizing Public Expenditure” concluded yesterday, Wednesday, in Rabat. This event, organized by the Kingdom’s Judicial Agency over two days, culminated in a series of strategic recommendations aimed at improving administrative performance, protecting public funds, and enhancing legal governance.

These recommendations fall within the framework of managing state disputes through a proactive approach based on protection and vigilance, evaluating performance development to ensure the safeguarding of public funds, improving the investment climate, and bolstering the confidence of citizens in public services.

Participants called for a careful balance between the continuity of public service and maintaining financial equilibrium, while also safeguarding citizens’ rights and ensuring their access to justice, all while upholding the Kingdom’s legal gains.

In this context, the debate was highlighted by the presentation of final reports that underscored the importance of adopting a comprehensive national strategy to enhance legal governance, administrative performance, and the rationalization of public spending, contributing to an improved business environment and strengthening investment stability in the Kingdom.

For his part, the Kingdom’s Judicial Agent, Abderrahmane Lamtouni, affirmed that the debate resulted in a set of main recommendations that branch out into 43 tangible executive measures. He emphasized that “these outcomes are the fruit of collective work involving various partners from government sectors, the judiciary, parliament, constitutional bodies, public institutions, and local authorities.”

Lamtouni stated in a press interview that “the issued recommendations represent a comprehensive roadmap to elevate the management of state disputes and prevent them, aiming to enhance public service quality, align administrative actions with legal standards, safeguard public funds, rationalize expenditures, and maintain the state’s financial balances.” He pointed out that “this debate addresses one of the central issues in the public management system.”

The four debate sessions and specialized workshops focused on fundamental issues including the formulation of a national strategy for managing state disputes, benefiting from comparative experiences, developing the legal framework for defending public law entities, as well as the importance of proactive management of legal and financial risks. The specialized workshops also addressed issues related to real estate disputes, the execution of judicial rulings, the recovery of public funds, and the role of good governance and digitization in improving dispute management.
