Wahbi: 2,605 Alternative Sentences and 1,578 Prisoners Released in Eight Months

Morocco’s Minister of Justice, Abdellatif Wahbi, has reported encouraging results from the implementation of Law No. 43.22 on alternative sentencing, which has seen over 2,600 sentences imposed since its introduction. This initiative aims to reduce prison overcrowding and facilitate the social reintegration of offenders while navigating various operational challenges.

The Progress of Alternative Sentencing

In a parliamentary response, Wahbi detailed that as of mid-April 2026, the alternative punishments issued included 1,075 daily fines—accounting for 41% of the total—1,027 community service sentences (39%), and 483 restrictions on certain rights or imposed monitoring measures (19%). There were also 20 cases involving electronic monitoring, representing just 1%. The minister emphasized that this initiative has resulted in the release of 1,578 prisoners and averted the incarceration of 90 individuals, contributing to a significant reduction in prison overcrowding.

Strategic Objectives and Early Outcomes

Wahbi highlighted that these preliminary outcomes reflect the broader strategic objectives of reforming the penal system. The aim is to rationalize custodial sentences and enhance rehabilitation programs within the prison system. This shift not only supports the overdue restructuring of how justice is administered but also seeks to empower the corrections administration to implement better reintegration strategies.

Challenges Ahead

Despite these positive developments, the minister acknowledged the hurdles that remain in the execution of alternative penalties. Key issues include tracking compliance with sentences, navigating various procedural complexities, and logistical limitations that hinder the effective use of electronic monitoring. The current landscape requires a concerted effort to improve coordination among stakeholders and enhance restorative justice mechanisms.

Future Directions

Looking forward, Wahbi underscored the necessity for increased collaboration and the expansion of legal frameworks governing alternative sentences. By balancing deterrence with rehabilitation, the Moroccan government aims to create a more effective justice system that not only alleviates prison overcrowding but also reduces recidivism rates.
