Success of New Civil Procedure Law Depends on Training, Digitalization, and Judicial Consistency

Reform of Morocco’s Judicial System: A New Legal Framework for Efficiency

The Moroccan Minister of Justice, Abdellatif Ouahbi, has asserted that the successful implementation of the new Civil Procedure Law hinges not only on the legislative framework but also on robust institutional conditions to ensure effective application and reform of the justice system.

A Turning Point in Judicial Reform

In response to questions from MP Latifa Abouth of the Haraki party, Ouahbi emphasized that the new law represents a significant milestone in Morocco’s justice reform initiative. This necessary overhaul aims to address economic, social, and technological shifts, while tackling persistent issues such as procedural delays and complexities that have emerged from the previous legal framework.

The newly introduced law shifts towards simplifying legal processes and expediting case resolutions. It also aims to optimize the use of legal defenses and appeals, thereby enhancing the judge’s role in managing cases and promoting judicial efficiency.

Key Features of the New Law

Among the law’s crucial elements are the digitalization of court proceedings, a restructuring of jurisdictional rules, and clearer timelines for appeals. Additionally, it aims to improve notification and enforcement processes while curbing frivolous defenses. It also expands judicial authority in case management, which is expected to streamline operations within the legal framework.

Ouahbi stressed that the success of this reform is dependent on the qualification and training of legal personnel, including judges, lawyers, and court clerks, as well as standardizing judicial practices and producing appropriate regulatory texts.

Investing in Human Resources

In this context, Ouahbi highlighted the role of the newly established National Institute of Court Clerks and Legal Professions, which commenced operations in 2024. This institution will focus on both initial and continuous training for court staff and various legal assistants, while the Higher Institute of the Judiciary will ensure that judges are well-versed in the new legal provisions.

Additionally, the Minister revealed that the Ministry of Justice, in collaboration with relevant stakeholders, is organizing workshops and seminars across the country to disseminate the law’s provisions. This outreach aims to facilitate effective implementation while bolstering public trust in the justice system.
