Parliament Approves Judicial Experts Bill to Strengthen Justice Reform
A A

Lead
In a decisive move towards justice reform, Morocco’s House of Representatives approved the Judicial Experts Law No. 01.24 during a session held last night, reflecting a significant political and legal discourse over its implications. With 80 votes in favor and 34 against, the legislation aims to modernize the framework governing judicial experts, essential for building public trust in the judicial system.

Reforming Judicial Expertise in Morocco

The approval of the Judicial Experts Law is part of Morocco’s ongoing efforts to enhance its justice system. Minister of Justice Abdellatif Ouahbi characterized the legislation as a vital step in restructuring legal and judicial professions, asserting their crucial role in ensuring judicial efficiency and confidence among litigants.

Key Provisions and Objectives

The new law seeks to revamp the regulatory framework for judicial experts by introducing several notable changes. Among these are revised registration requirements and the age criteria for entering the national registry. Additionally, the law broadens its scope to include legal entities as potential judicial experts.

One of the pivotal aspects of the legislation is the mandatory foundational training for new judicial experts, coupled with a requirement for ongoing education to keep their legal and professional knowledge updated. Moreover, the guidelines stipulate that fees for services rendered will be determined based on the complexity and efforts involved in expert evaluations.

Strengthening Accountability

On the disciplinary front, the law bolsters oversight mechanisms by holding experts accountable for their professional errors, including those made by their assistants, while ensuring they receive legal protection. Another stipulation mandates that experts over the age of 70 present annual medical certificates confirming their fitness to perform their duties.

Ouahbi emphasized that the evolving nature of society, coupled with increasingly complex legal disputes, necessitates specialized technical expertise. He underscored that enhancing the work quality of judicial experts is critical to improving judicial performance.

Mixed Responses from Lawmakers

While the ruling coalition heralded the law as a cornerstone in the justice reform framework, highlighting its relevance in addressing the urgent need to update legal parameters in response to the changing nature of court cases, opposition parties called for a more comprehensive approach to sector reform. They argued that judicial experts have become integral to the judicial decision-making process, given the intricacies of modern legal challenges.

Opposition members also stressed the need for legally binding timelines for conducting expert assessments, accompanied by penalties to mitigate litigation delays. Additionally, they advocated for the establishment of a national and regional body for judicial experts to institutionalize practices and standardize criteria, thereby enhancing their independence.

Implications for Morocco’s Legal Landscape

The passage of the Judicial Experts Law marks a pivotal moment in Morocco’s legal evolution, heralding a future where judicial expertise is more strategically integrated into the decision-making framework. As the justice system evolves, the profound implications of these reforms will be felt in both the immediate and long-term effectiveness of legal proceedings across the nation.
