Grok Tests the Effectiveness of AI Governance
In recent weeks, the chatbot Grok—a system developed by Elon Musk’s xAI—has been embroiled in controversy for generating sexual images without consent of women and children on the social media platform X. This has prompted investigations and official scrutiny from regulatory bodies in the European Union, France, India, Malaysia, and the United Kingdom. European officials have described this behavior as illegal, leading UK regulators to launch urgent inquiries. Other governments have warned that Grok’s outputs may violate local criminal laws and platform safety regulations. Beyond these marginal regulatory disputes, discussions are reaching the core of AI governance.
Governments around the world are increasingly agreeing on a fundamental premise regarding AI management: systems deployed at scale must be safe, controllable, and subject to genuine oversight. These standards are clear and consistent, whether outlined in the European Union’s Digital Services Act (DSA), the OECD’s AI principles, UNESCO’s AI ethics framework, or emerging national safety regulations. AI systems that allow foreseeable harm, especially sexual exploitation, do not align with societal expectations of this technology and its governance.
There is also widespread international consensus that sexual imagery involving minors—whether real, altered, or AI-generated—represents one of the most evident red lines in technology governance. This is affirmed by international law, human rights frameworks, and local criminal laws.
The generation of such materials by Grok does not fall into a gray area; it signifies a clear and fundamental failure in system design, safety evaluations, oversight, and control. The ease with which Grok can be prompted to produce sexual images involving minors, the broad regulatory scrutiny it now faces, and the absence of verifiable safety tests all point to a failure to meet basic societal expectations regarding powerful AI systems. Musk’s announcement that the image generation service would now only be available to paying subscribers does not resolve these failures.
This is not a marginal issue. Last July, the Polish government urged the European Union to investigate Grok due to its “deviant” behavior. In October, over twenty civil organizations and public interest groups sent a letter urging the U.S. Office of Management and Budget to suspend the planned deployment of Grok across federal agencies. Many AI safety experts have expressed their concerns about the adequacy of protective measures in place when using Grok, with some observers claiming that the safety architecture is insufficient for a system of this scale.
These concerns have largely been ignored as governments and political leaders sought to engage with, partner with, or court xAI and its founder. However, the fact that Grok is now under scrutiny in multiple jurisdictions seems to validate these concerns, while revealing a deeper structural problem: advanced AI systems are being released and made available to the public without corresponding safeguards proportional to their risks. This should serve as a warning to nations contemplating the deployment of similar AI systems.
As governments increasingly embrace AI systems in public administration, procurement, and political workflows, maintaining public trust necessitates guarantees that these technologies comply with international commitments, respect fundamental rights, and do not expose institutions to legal or reputational risks. To this end, regulatory bodies must use the Grok case to demonstrate that their rules are not optional.
Responsible AI governance relies on consistency between stated principles and operational decisions. While many governments and international regulatory bodies have outlined their commitments to safe, objective, and continuously monitored AI systems, these commitments lose credibility when nations tolerate the deployment of systems that widely violate shared international standards with apparent impunity.
In contrast, suspending the deployment of a model pending a rigorous and transparent assessment in line with global best practices in AI risk management allows governments to ascertain whether the system complies with local law, international standards, and evolving safety expectations before it becomes further entrenched. Equally importantly, this proves that governance frameworks are not merely aspirational statements, but operational constraints—violations will incur real consequences.
The Grok incident underscores a vital lesson in the age of AI: governance gaps can rapidly widen in tandem with technological capabilities. When preventive safeguards fail, the damage is not confined to a single platform or jurisdiction; it spreads globally, triggering responses from public institutions and legal systems.
From the perspective of European regulators, Grok’s recent output represents a crucial test of whether the Digital Services Act (DSA) will operate as a binding enforcement system or merely as a statement of intent. As governments in the EU and beyond continue to outline global AI governance, this issue may serve as an early indicator of what tech companies can expect when AI systems cross legal thresholds—especially when the harm involves horrific behaviors like the sexual exploitation of children.
In fact, a response limited to public statements of concern will only lead to further violations in the future, as it indicates that enforcement lacks teeth. Conversely, a response that includes investigations, suspension of operations, and penalties will clarify that certain boundaries cannot be crossed, regardless of the company’s size, reputation, or political influence.
Grok should not be treated as an unfortunate outlier to be quietly managed and then forgotten, but rather as a serious violation, as it indeed is. At a minimum, a formal investigation, publication suspension, and imposition of real penalties should take place.
Lenient security measures, inadequate safeguards, or meager transparency regarding safety tests cannot go unpunished. Wherever government contracts contain provisions related to safety, compliance, or termination for cause, they should be enforced. Whenever laws prescribe penalties or fines, they must be applied. Anything less risks sending a signal to the largest tech companies that they can deploy AI systems recklessly, without fear of facing accountability if those systems breach even the most fundamental legal and ethical boundaries.
