New Draft Law for Compensating Victims of Traffic Accidents

The governmental council approved on Thursday, September 4, the draft law No. 24.70 related to amending the royal decree No. 1.84.177 issued on October 2, 1984, concerning compensation for traffic accident victims. This was presented by the Minister of Justice, Abdellatif Ouahbi.

During his presentation, the minister emphasized that this reform comes in the context of implementing constitutional provisions that guarantee the fundamental rights of citizens and in response to the urgent need to develop the legal framework for the rights of traffic accident victims. This aims to ensure fair and equitable compensation that aligns with the economic and social transformations occurring in the country.

Ouahbi noted that the goal of the draft law is to establish greater social justice for traffic accident victims and their beneficiaries through fair compensation, simplified procedures, and clear legal guarantees, thereby enhancing citizens’ trust in justice and reinforcing the principles of fairness and equality.

The draft law introduces several key updates, including:

– Expanding the beneficiaries of compensation to include new categories such as foster children, students, and trainees.
– Improving financial compensation by revising the calculation mechanisms and raising the minimum and maximum wage limits.
– Introducing new mechanisms for amicable dispute resolution to shorten the timeframes for resolving cases and enhance procedural efficiency.
– Clarifying legal definitions and key terms to avoid conflicting interpretations and simplify procedures for the affected parties.

These reforms are expected to better protect the rights of traffic accident victims and their families in a more equitable manner, establishing a modern legal framework that aligns with international standards and enhances social justice in Morocco.
