Moulay Hassan Daki Affirms the Public Prosecution’s Commitment to Implementing Alternative Penalties to Ensure Effective Justice

Moulay Hassan Dakki confirmed the Public Prosecution’s commitment to implementing alternative penalties to ensure effective justice.

Moulay Hassan Dakki, Attorney General at the Court of Cassation and Head of the Public Prosecution, inaugurated the two-day seminar on alternative penalties, held on May 7 and 8, 2025, at the Conrad Hotel in El Harhoura, Rabat. This event was organized by the Public Prosecution in partnership with the Council of Europe and in coordination with the General Delegation for Prison Administration and Reintegration.

Dakki emphasized the significance of this scientific meeting, aimed at discussing the provisions of Law No. 43.22 concerning alternative penalties, and analyzing ways to implement it at both judicial and administrative levels. He praised the role of judges in enforcing penalties and the Public Prosecution, as well as the crucial participation of the General Delegation in monitoring the execution of alternative penalties, alongside various partner institutions that will facilitate their implementation.

He acknowledged the active participation of the President of the Supreme Judicial Council and the Minister of Justice, valuing their support for the Public Prosecution’s initiatives, particularly regarding training judges and enhancing their competencies, as well as bringing this legal text into being. He also appreciated international cooperation, especially from the Council of Europe and the European Union, and the role of foreign experts present to share successful comparative experiences in this field.

Dakki stressed the importance of this meeting in the context of preparing to activate the aforementioned law in August, viewing alternative penalties as a significant shift in the penal system due to their advantages in promoting reintegration and reducing the impact of imprisonment, particularly concerning prison overcrowding and the ineffectiveness of short-term custodial sentences.

He confirmed that the alternative penalties established under the new law fall into four categories: community service, electronic monitoring, restrictions on certain rights or the imposition of therapeutic and rehabilitative measures, and daily fines. He explained that these new forms grant the judiciary the authority to replace effective custodial penalties with measures that ensure the convicted individual remains within their social environment and continues their professional role.

Dakki indicated that the Public Prosecution plays a pivotal role in activating Law No. 43.22, by submitting requests for the substitution of penalties and accompanying the execution phases. He urged prosecutors to be diligent in this endeavor, reiterating that the Public Prosecution will take all necessary measures to ensure optimal and effective implementation of its provisions.

He noted that the presidency has worked to issue a circular urging engagement in executing the law and has contributed to thematic meetings to prepare the regulatory texts and develop a framework for applying penalties, especially those related to community service and electronic monitoring. Additionally, a practical guide will be prepared and distributed to judges as soon as the implementing decree is issued.

Dakki also encouraged participants to leverage this opportunity to exchange experiences and learn about best European practices, ensuring that alternative penalties are adapted to the specificities of Moroccan reality and enhancing the effectiveness of criminal policy. He affirmed the continued efforts of the Public Prosecution to organize training sessions and communication meetings to overcome any challenges hindering the optimal application of this law.

He concluded his remarks by expressing gratitude to all institutional and international partners, commending the collective will to ensure effective and humane justice that embodies reform and integration, reflecting the directives of His Majesty King Mohammed VI. He prayed for continued blessings of security and justice under the wise leadership of King Mohammed VI.
