Moroccan Minister of National Education, Preschool Education, and Sports, Mohamed Saad Barada, issued a clarifying statement to the public on Monday, responding to recent claims circulated by some news websites that alleged a breach of the regulatory law concerning government operations.
The minister asserted that these allegations are “misleading and lack accuracy,” before providing detailed explanations regarding his legal status, stressing his full compliance with the applicable procedures.
Barada explained that he tendered his resignation from all companies on October 23, 2024, which was documented with the public authorities in Casablanca the following day. He noted that he informed the boards of directors of the two relevant companies about his immediate resignation, calling for the necessary actions to be taken by the competent authorities.
In this context, the minister emphasized that his resignation is “effective and has legal consequences from the time it was submitted,” confirming that its registration in the commercial register is not a condition for its effectiveness, but merely a procedural step for public notice concerning the company’s stakeholders.
Barada also addressed the provisions of the regulatory law governing government operations, reminding that Article 33 explicitly exempts companies whose activities are limited to acquiring shares or managing securities from conflict of interest scenarios. Nevertheless, he stressed that he chose to resign from BIP Partners, despite its eligibility for this exemption.
The minister concluded his statement by affirming that he carries out his governmental duties in complete adherence to the law, reiterating his commitment to clarifying all information to the public “in accordance with the principles of transparency and accountability,” safeguarding public discourse against any attempts of misinformation or misinterpretation.
