Baitas Announces Government Approval of New Law Regulating the Notary Profession
On Thursday, the government approved Bill No. 16.22, aimed at reorganizing the notary profession, following the incorporation of remarks made during its discussion in the council, as presented by the Minister of Justice to the government members.
The Minister Delegate in Charge of Relations with Parliament and Government Spokesperson, Mustafa Baitas, stated in a statement after the weekly council meeting that the preparation of this legal text stems from the significant importance of the notary profession within the judicial system, due to its essential role in documenting transactions, protecting rights, and safeguarding lineage and honor, which enhances legal security and reduces the chances of disputes and reliance on courts.
Baitas explained that the bill aims to update the currently applicable legislative framework governing the profession, under the 2006 Justice Plan Law. The new project introduces a series of amendments that respond to the evolution of the profession and the expectations of professionals and their clients.
Among the key innovations included in the project is a revision of the conditions for entering the profession, activating Recommendation No. 11 of the National Charter for Justice System Reform, which concerns re-evaluating the conditions for entering legal and judicial professions, thereby opening the door for women to join the profession, in line with royal directives calling for the promotion of equality.
The new amendments also encompass provisions related to regulating the practice of the profession, standardizing document drafting and receiving attestations, formalizing the certification of the notarial act, and establishing new controls for it, in addition to modern mechanisms for preserving documents and records while ensuring access to copies upon request, as well as restructuring the National Notary Body and defining its processes and structures.
