The Public Prosecution Presidency: “Pretrial Detention is the Last Resort”

The Public Prosecution Presidency has issued a circular numbered 11/2025 to various public prosecutor offices across the Kingdom, emphasizing that pretrial detention should only be used as a last resort in cases of utmost necessity.

The presidency also stressed the importance of adopting an approach that preserves individual freedoms without compromising societal security, in clear alignment with international human rights charters. Furthermore, it highlighted the use of restorative practices in cases that do not necessitate pretrial detention.

In this circular, the Public Prosecution Presidency called upon all the Attorney General and King’s Attorney offices to closely and regularly monitor files to avoid any potential delays in case resolutions.

This circular praised the effective and close coordination among all local and regional committees responsible for overseeing the implementation of pretrial detention, noting that this coordination has enabled Morocco to reduce detention rates to less than 30%, a historic achievement.

The presidency underscored the constitutional role played by various public prosecutor offices in safeguarding individual rights and freedoms while maintaining societal security, urging them to seek assistance if they encounter any difficulties or constraints that impede their field operations.
