Alternative Sentences Come into Effect: Public Prosecution Confirms Readiness to Implement New Law
The Attorney General at the Court of Cassation and head of the Public Prosecution has asserted that the adoption of alternative sentences marks a qualitative shift in criminal policy in Morocco, reflecting the collective will among institutions to reform the justice system in line with the major recommendations of the National Charter and international human rights standards.
This statement was made during his speech at the national communication meeting organized by the Supreme Council of the Judiciary in Rabat, regarding Law No. 43.22 related to alternative sentences. The judicial official emphasized that this meeting is a fundamental step to ensure the smooth implementation of the new provisions established by the legislator, noting the importance of unifying legal perspectives and enhancing training for judges to establish a new approach to dealing with crime and punishment.
The Attorney General highlighted the challenges posed by custodial sentences, clarifying that the increasing reliance on imprisonment has not proven to enhance security indicators; rather, it has contributed to a rise in the number of detainees worldwide, surpassing ten million. He considered this reality reflects complex economic, social, and technological issues that require rethinking traditional punitive tools.
He further explained that Law No. 43.22 opens the door for the adoption of four types of alternative sentences, including community service, electronic monitoring, restrictions on certain rights or the imposition of corrective and rehabilitative measures, and daily fines. He noted that this law targets offenses for which the penalty does not exceed five years of imprisonment, providing a real opportunity for lawbreakers to correct their behavior without isolating them from society.
He asserted that the Public Prosecution plays a pivotal role in implementing this legislation by requesting the substitution of custodial sentences with alternative sanctions, monitoring their implementation, and contributing to resolving related disputes, which requires prosecutors to be decisive in application and vigilant in supervision.
Additionally, he mentioned that the Presidency of the Public Prosecution is committed to monitoring and evaluating the impact of these alternative sentences on penal policy, aiming to enhance their effectiveness and reduce the burdens associated with prison overcrowding. He highlighted that experiences from several countries have confirmed that alternative sentences are just as effective as imprisonment, and sometimes even more so, regarding their positive impact on reintegration.
He considered that this scientific meeting constitutes a lively opportunity to exchange experiences and coordinate efforts among various stakeholders to ensure the successful implementation of this law, calling for the serious engagement of all actors to guarantee a more efficient and effective criminal justice system.
He concluded his remarks by expressing gratitude to the Supreme Council of the Judiciary for organizing this meeting, praising ongoing training initiatives targeting judges and all stakeholders in the system, and urging everyone to continue working towards a criminal justice system that safeguards rights and serves the public interest under the wise leadership of King Mohammed VI.
