Morocco’s public procurement system is undergoing significant administrative simplification, following a new directive aimed at easing the requirements for smaller contracts. This initiative by Budget Minister Fouzi Lekjaa seeks to streamline processes, allowing strategic projects to gain the focus they need while reducing bureaucratic hurdles for smaller expenditure.


A Shift in Procurement Policy
The recent adjustments to public procurement regulations in Morocco can be traced back to the implementation of Article 23 of Decree No. 2.22.431. This revision has raised the financial thresholds that dictate mandatory extended publication periods for tenders, marking a strategic pivot towards balancing administrative efficiency and competitive fairness.

New Financial Thresholds
Under the new framework, a uniform threshold of 65,086,000 dirhams (approximately $6.7 million) for construction projects has been established, regardless of whether the contracting authority is the state, local governments, or public institutions. This consolidation simplifies the existing rules and minimizes the complexity associated with multiple standards. For supplies and services, new thresholds have been set based on the entity involved: 1,692,236 dirhams for state contracts, 4,621,106 dirhams for local governments, and 8,700,000 dirhams for public institutions. These increases reflect a clear intent to limit the use of complex tendering processes for routine expenditures.

Accelerating Small and Medium Projects
This reform is expected to expedite the execution of small and medium-sized projects by alleviating the administrative burden on financial managers while granting them greater flexibility in resource management. At the same time, the directive ensures that the mechanisms for competition and transparency remain intact for larger projects, which require wider participation from competitors and greater governance assurances.

Towards a New Philosophy
Observers note that this shift represents a transformation in the philosophy of public procurement management, moving from a model of rigorous oversight to one centered on efficiency based on project size and economic impact. However, the success of this reform hinges on the ability of administrations to uphold principles of transparency and equal opportunity, particularly for contracts that will no longer be subject to extended publication requirements.

In conclusion, raising the publication thresholds is a practical step towards rationalizing public procurement processes, striking a balance between accelerating administrative performance and ensuring competitive integrity in a context that increasingly demands effective implementation of public policies.
