The Administrative Court in Agadir has ruled to dismiss eight local councilors from the councils of Inzegane, Ait Melloul, and Ouled Dahou due to conflicts of interest. The court has mandated that all legal consequences resulting from this decision be enforced immediately.
This ruling came in response to a lawsuit filed by the Governor of the Inzegane-Ait Melloul region, following the initiation of legal proceedings against the individuals involved, who were found to be in situations of potential conflicts of interest. The governor had previously sent written inquiries to the councilors based on Article 64 of the organic law No. 113.14 concerning local authorities, granting them a ten-day period to provide explanations before the case was referred to the administrative court.
According to available data, the dismissal order affected five councilors from the Inzegane council, two from the Ouled Dahou council, and one from the Ait Melloul council.
Prior to this, the governor had issued orders suspending the affected elected officials from carrying out their duties within their respective councils, immediately after submitting the request for their dismissal to the judiciary. This action was taken in accordance with legal provisions that empower the regional authority to implement such measures when there is suspicion of conflicts of interest.
The ruling underscores a judicial trend emphasizing intensified oversight of potential conflicts of interest within local councils, in line with efforts to enhance transparency, governance, and accountability.
