Rhamna Province: The Administrative Court Strips a Municipal Councilor of Her Membership

The Administrative Court in Marrakech has issued a final ruling, number 3542, stripping Zouhour Al-Kafi of her membership in the municipal council of Ras Al-Ain within the Rhamna province, along with all legal consequences of this decision, and ordering her to bear the judicial costs.

The ruling stated: “In the name of His Majesty the King and pursuant to the law, the appeal is accepted procedurally, and in substance, Zouhour Al-Kafi is stripped of her membership in the municipal council of Ras Al-Ain Rhamna, with all legal implications thereof and she bears the costs.”

According to sources from Express TV within the court, the Secretary-General of the Istiqlal Party, Nizar Baraka, initiated the process to strip the municipal councilor Zouhour Al-Kafi, due to accusations of her non-compliance with party decisions and deviation from its political line.

This decision comes amid the leadership’s insistence on maintaining internal discipline within the Istiqlal Party and activating legal provisions related to accountability within party organizations, particularly concerning elected representatives who act on behalf of the party in local councils.

The ruling falls under the provisions of Organic Law No. 113.14 concerning local communities, which permits the stripping of an elected member from their position if they abandon the political affiliation under which they were elected or violate the directives of their political body. The law grants political parties the right to contact the government authority responsible for the interior to request the initiation of the stripping process, which is then referred to the administrative judiciary for a final ruling.

Following the issuance of the ruling, Zouhour Al-Kafi is expected to be replaced by the next candidate on the Istiqlal Party list from the recent local elections, in accordance with the principle of gender parity on the list and to ensure continuity of the party’s representation within the council.
