The Public Prosecutor’s Office in Agadir Reviews Procedures for Implementing Alternative Sentencing Law to Ensure Its Success
The Public Prosecutor’s Office at the Court of Appeal in Agadir organized a training day on the Alternative Sentencing Law at the court, featuring prominent figures in the fields of justice and security, such as Mr. Abd al-Razzaq Fattah, the Attorney General, and Mr. Mustafa Imrabtin, the Security Chief of Agadir, along with several public prosecutors and heads of security services in the region. This training day aimed to activate Law No. 43.22 related to alternative sentences, which came into effect on August 22, 2025.
Initially, Abd al-Razzaq Fattah highlighted the vital roles the Public Prosecutor’s Office will play in implementing this law. He explained how the process begins at the trial stage, where the Public Prosecutor has the right to propose alternative sentences, extending to the monitoring of their implementation and post-execution follow-up to ensure the reintegration of the convicted individuals into society. He emphasized the organizational steps taken by the Public Prosecutor’s Office, such as the establishment of a specialized department for alternative sentencing and the designation of dedicated staff to oversee the implementation of these penalties.
An electronic registry dedicated to these sentences has also been created to closely monitor the progress of cases. Additionally, the Attorney General indicated that the specialized unit formed within the Public Prosecutor’s Office would identify any challenges in implementation and provide appropriate solutions.
Hassan Aainaya, the Regional Director of Prisons in Souss-Massa, presented the role of the prison administration in executing these sentences and pointed out the importance of coordination among various stakeholders in implementing this law, as well as the challenges associated with executing alternative sentences within prison facilities.
At the conclusion of the training day, several issues that could hinder the implementation of this law were addressed, and the importance of collective action among all parties to overcome these challenges was reaffirmed. Attendees expressed their satisfaction with the progress made in this area, affirming their full commitment to implementing this project in a way that achieves the noble goals of the legislator, primarily working towards social justice and reducing overcrowding in prisons.
