The Ministry of Justice: The Constitutional Court’s Decision Strengthens the Rule of Law and Establishes Interaction Between Institutions

The Ministry of Justice welcomed the Constitutional Court’s decision regarding Bill No. 23.02 related to civil procedure, considering this ruling a pivotal moment in reinforcing the rule of law and enhancing guarantees within the judicial system.

In an official statement released yesterday, the Ministry emphasized that the decision reflects the vitality of constitutional institutions and embodies positive interaction among authorities, respecting the principle of separation of powers, the rule of law, and the protection of rights and freedoms.

The Ministry stressed that the draft law in question underwent an extensive legislative process, adopting a participatory approach that included discussions within the government and parliament, and was based on broad consultations with various stakeholders, including judges, professional bodies, and human rights organizations.

In this context, Justice Minister Abdellatif Ouahbi stated that the Constitutional Court’s decision reflects the strength of institutions, adding: “We do not fear constitutional oversight; rather, we encourage it and see it as a true guarantee of the rule of law. This decision strengthens our reform project within the institutions and the power of those institutions.”

The Ministry reaffirmed its commitment to continuing institutional dialogue to align legal texts with constitutional provisions, and to developing legislation that responds to societal transformations while reinforcing the principles of judicial security, efficiency, and transparency.

It noted that the observations made in the Constitutional Court’s ruling represent added value to legislative work, indicating that it will take the necessary measures, in coordination with stakeholders, to adapt legal provisions in line with the judicial decision, serving the interests of litigants and enhancing the comprehensive reform of justice.
