A U.S. appeals court finds Trump’s tariffs illegal while keeping them temporarily in effect

A federal appeals court ruled Friday, August 29, that a significant portion of the tariffs imposed by President Donald Trump’s administration is not in compliance with the law, but it has kept them in effect pending a decision from the Supreme Court, the country’s highest judicial authority.

The new ruling reaffirmed a previous lower court decision, stating that levying taxes on foreign imports in general, without targeting specific sectors, exceeds the powers granted to the president in cases of national emergencies. However, the execution of the ruling is delayed until October 14, maintaining the tariffs in question.

Trump, who commented on the decision via his platform Truth Social, emphasized that “all tariffs remain in place” and will be “used to serve the country.” He deemed the appeals court ruling “heavily biased,” warning that the removal of tariffs would be a “complete disaster” for the United States.

Since returning to the White House in January, Trump has imposed several waves of tariffs ranging from 10% to 50% depending on the type of products and their countries of origin. It is important to note that the challenged measures differ from the specific tariffs applied to sectors like cars, steel, aluminum, and copper.
