Elected councils’ violations under the scrutiny of governors and regional delegates

Governors and regional delegates across the kingdom have issued strict observations to several local councils regarding the transfer and rental of various communal properties without adhering to the applicable legal procedures.

This action is part of the implementation of the joint decision between the Ministries of Interior and Economy and Finance No. 3712.21, issued at the end of 2022, which mandates bidding processes according to a specific charter, given that this category of operations is subject to meticulous post-control by specialized committees.

Additionally, the central authorities of the Ministry of Interior have received alarming reports concerning illegal maneuvers by some elected councils to facilitate unauthorized benefits from communal properties through what is known as “direct dealings.” It has been pointed out that these councils have violated strict procedures requiring the implementation of bidding processes according to the charter during transfer, rental, and temporary occupation activities, while committing to all legal stages. Furthermore, these councils have initiated extensive agendas in regular sessions that include numerous points related to the disposal, sale, and repurposing of communal properties, aiming to mobilize financial resources for expropriation processes or for investment in new real estate assets, or based on requests from legal or natural persons, raising suspicions about the adoption of new evasion methods.

The governors and regional delegates’ observations included inquiries directed at the heads of local councils regarding their compliance with legal regulations and the central authorities’ guidelines related to the management of communal properties, particularly those outlined in the correspondence from the Property Directorate, which is part of the General Directorate of Local Authorities.
