The rise in assaults against state employees prompts the Public Prosecution to implement strict protective measures

The Presidency of the Public Prosecution has issued a new circular to district attorneys and crown attorneys in various courts across the kingdom, urging them to tackle assaults targeting law enforcement officials with strictness and firmness. The official document, dated June 16, 2025, comes in the context of a concerning increase in the number of cases involving violence and insult directed at this category of state employees.

The circular clarifies that protecting this group is a priority in the national criminal policy, given their vital role in enforcing laws and ensuring public security. It noted that Moroccan legislators have established a legal framework for their protection for years, particularly in Articles 263 to 267 of the Penal Code, in addition to specific provisions such as Article 7 of the Royal Decree regarding National Security Employees.

Statistical data included in the circular indicated a significant rise in cases related to violence against public employees, escalating from 3,549 cases in 2018 to 6,888 cases in 2024, involving more than 8,200 individuals. This increase reflects the magnitude of the risks faced by this group while performing their duties and highlights the need for enhanced legal and practical protection.

The Public Prosecution called for a set of measures, primarily the initiation of comprehensive judicial investigations in all cases of assault, the appropriate legal classification, activation of recidivism cases, rigorous advocacy before the judiciary, and the submission of appeals when judicial rulings do not match the severity of the actions. It also emphasized the need to promptly notify the presidency in cases of serious assaults or those that attract public interest.

The circular affirmed the importance of documenting assaults by audio or video if available, preparing precise reports in accordance with the law, and ensuring full coordination between the components of the judicial and security authorities. It further reiterated the necessity of considering these directives in various cases presented to guarantee deterrence, achieve effective protection for state employees, and uphold the dignity of institutions and respect for the rule of law.
