Minister Wahbi: The Issue of Contribution and Family Justice is Not a Legal Debate

Justice Minister Abdellatif Wahbi stated that Morocco is confidently moving towards establishing justice within the family, considering the revision of the Family Code led by King Mohammed VI as a bold strategic choice reflecting clear political will to uphold the rights of both women and men.

Wahbi’s remarks came during the opening of an international symposium in Rabat on Wednesday, June 18, 2025, dedicated to discussing the legal and historical approach to the system of contribution and its implications, with participation from judicial, diplomatic, and academic figures from Morocco and the Arab world.

The Minister emphasized that the debate surrounding contribution exceeds theoretical or legal frameworks, framing it as a pressing human and social issue that touches on the essence of familial relationships. He added that the time has come to transition from fragmented judicial interpretations to explicit legal texts that recognize women’s contributions to family wealth development.

Wahbi pointed out that several Moroccan courts have previously adopted this principle based on custom and the Maliki school of thought, stressing that acknowledging women’s productive roles both at home and outside is part of the social justice that the state aims to solidify.

He further mentioned that this step does not contradict religious tenets but aligns with the objectives of Islamic law and its spirit centered on justice and fairness, as well as with the human rights commitments that Morocco has willingly embraced in its democratic journey.

Wahbi continued that the Ministry of Justice will persist in working on this initiative in coordination with all stakeholders to formulate realistic and just legal texts that ensure family stability and uphold the dignity of all family members, urging the utilization of comparative experiences from the Arab countries represented at the symposium.

The minister concluded by asserting that the fight for justice within the family is not solely a Moroccan issue but concerns all Arab societies, calling for enhanced collaboration and exchange of ideas to shape a modern legal system that enshrines the principle of equality and fosters social peace.
