Hassan Daki Emphasizes the Role of Dispute Management in Upholding the Rule of Law and Encouraging Investment

Hassan Daki, the Attorney General of the Court of Cassation and President of the Public Prosecutor’s Office, expressed his great pride in participating in the opening of the national symposium on state dispute management and prevention. He commended the efforts made to organize this symposium, which addresses a topic of significant importance in the context of the economic development and stability of the Kingdom.

In his opening remarks, Daki highlighted that managing and preventing state disputes is not merely a technical procedure but represents a comprehensive philosophy aimed at enhancing trust between parties, supporting consensual solutions, and providing a stable and secure investment environment. He underscored that these efforts fall within the framework of reinforcing the rule of law, achieving judicial efficiency, and optimizing public expenditure, asserting that investment is a fundamental pillar for achieving economic growth and creating job opportunities.

The Public Prosecutor emphasized that the Kingdom’s constitution provides a solid foundation for upholding legality through principles of good governance and holding accountability, referencing the High Royal Message directed to participants at the International Justice Conference in 2019, which called for the establishment of an effective legal framework for resolving investment disputes within reasonable timeframes while considering their specificities.

In this regard, Daki reviewed several initiatives undertaken by the Public Prosecutor’s Office, including organizing scientific seminars and developing electronic document exchange mechanisms with the Kingdom’s judicial authority, which contributed to improving the defense of the Public Prosecution’s interests and reducing financial claims against the state by more than 94 million dirhams between 2019 and 2024.

He also emphasized the importance of anticipating legal risks and adopting alternative solutions such as mediation and arbitration, along with enhancing coordination between judicial, administrative, and professional institutions. He called for drawing from best practices in comparative experiences and developing more effective mechanisms to reduce the volume of disputes and achieve legal stability.

In conclusion, Daki reiterated his gratitude to all participants in the symposium, expressing hope that these meetings would lead to practical recommendations that bolster the legal and economic stability of the Kingdom under the wise leadership of His Majesty King Mohammed VI, may God assist him.
